Effective Date: June 2026

Your Rights

When it comes to your health information, you have certain rights under federal and Texas state law. This section explains your rights and some of our core responsibilities:

  • Get an electronic or paper copy of your medical record: You can ask to see or receive a copy of your home health records and other health information we maintain about your care. We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.
  • Ask us to correct your medical record: You can ask us to correct health information about you that you believe is incorrect or incomplete. We may say “no” to your request, but we will explain why in writing within 60 days.
  • Request confidential communications: You can ask us to contact you in a specific way (for example, home or mobile phone) or to send mail to a specific address. We will say “yes” to all reasonable requests.
  • Ask us to limit what we use or share: You can ask us not to use or share certain health information for treatment, payment, or operational purposes. We are not required to agree to your request, and we may say “no” if it would affect your care. If you pay for a service or care item out-of-pocket in full, you can ask us not to share that information with your health insurer for payment or operations, and we will honor that request unless a law requires otherwise.
  • Get a list of those with whom we’ve shared information: You can ask for an accounting of the times we’ve shared your health information for six years prior to the date of your request, including who we shared it with and why. This excludes disclosures related to direct care treatment, billing/payment, standard operations, and disclosures you specifically authorized. We provide one accounting per year for free, but may charge a reasonable, cost-based fee for additional requests within 12 months.
  • Get a copy of this privacy notice: You can request a paper copy of this notice at any time, even if you previously agreed to receive it electronically.
  • Choose someone to act for you: If you have granted someone medical power of attorney or if someone is your legal guardian, that individual can exercise your privacy rights and make choices about your health information once we verify their legal authority.
  • File a complaint if you feel your rights are violated: You can register a complaint if you feel your rights have been violated by contacting our Privacy Officer at Everford Caregivers in Dallas, TX. You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights:

Your Choices

For certain health information, you can instruct us on what we share. If you have a clear preference for how we share your information in the following situations, let our care team know:

  • In these cases, you have both the right and choice to tell us to:
    • Share information with family members, close friends, or designated primary caregivers involved in your home care or 24-hour support plan.
    • Share information in a disaster relief or emergency scenario.
    • Contact you for fundraising or community outreach efforts.
  • If you are unable to tell us your preference (e.g., if you are unconscious or incapacitated during an emergency), we may share your information if we determine it is in your best clinical interest, or to lessen a serious and imminent threat to health or safety.
  • Written Permission Requirements: We never share your information for marketing purposes, sell your information, or share psychotherapy notes without your explicit written permission.

Our Uses and Disclosures

How do we typically use or share your health information to deliver home health and 24-hour support?

  • To Provide Home Care & Treatment: We use your health information and share it with physicians, home health aides, nurses, or therapists who are involved in your care.

  • Run Our Organization: We use and share your health information to run our practice, improve quality of care, manage staffing schedules, and contact you or your family when necessary.
    • Example: We evaluate health record data to optimize shift transitions between day and night care teams.
  • Bill for Services: We use and share your health information to invoice and collect payment from health plans, long-term care insurance, or other responsible payment entities.
    • Example: We provide billing documentation to your insurance provider so they will cover your authorized home care hours.

Additional Public Interest & Legal Disclosures

We are allowed or required to share your information in other ways—typically to comply with legal mandates or contribute to public health:
